These Affiliate Marketing Terms & Conditions (“Agreement”) govern participation in the affiliate marketing program (“Program”) operated by Hold My Kush (“Company,” “we,” “our,” or “us”).
By registering as an affiliate, you (“Affiliate,” “you,” or “your”) agree to comply with the following terms.
1. Eligibility
To participate in this Program, you must:
- Be at least twenty-one (21) years old or the legal age required in your jurisdiction.
- Operate legally in your location.
- Have a valid payment method and contact information.
- Not reside in a jurisdiction where cannabis promotion is prohibited.
The Company reserves the right to approve or reject any affiliate application at its sole discretion.
2. Affiliate Responsibilities
Affiliates agree to:
- Promote the Company ethically and lawfully.
- Accurately represent the Company’s products and services.
- Comply with all applicable advertising, cannabis, and consumer protection laws.
- Clearly disclose affiliate relationships in accordance with applicable marketing regulations.
Affiliates may not:
- Make false medical claims about cannabis products.
- Promote products to minors.
- Use deceptive, misleading, or offensive advertising.
- Impersonate the Company or represent themselves as employees.
- Bid on the Company’s trademarked terms in paid advertising unless authorized in writing.
3. Restricted Marketing Activities
The following promotional methods are strictly prohibited:
- Spam emails or unsolicited messages
- Fake reviews or testimonials
- Promotion on websites targeting minors
- Promotion on illegal streaming, adult, hate, or violent content platforms
- Misleading discount claims
- Unauthorized coupon distribution
- Use of bots, fake traffic, or click fraud
Violation may result in immediate termination and forfeiture of commissions.
4. Affiliate Links & Tracking
Affiliates will receive a unique referral link or code.
Commissions are only paid on verified purchases tracked through the official affiliate system. The Company is not responsible for:
- Tracking failures caused by browser settings or ad blockers
- Incorrect affiliate links
- Tampered or fraudulent tracking activity
5. Commission Structure
Affiliates will earn commissions based on eligible sales generated through approved referral links.
Commission details:
- Rate: 20%
- Payment Schedule: Weekly
- Minimum Payout Threshold: 100
- Payment Method: Bitcoin
The Company reserves the right to modify commission rates with prior notice.
6. Returns, Chargebacks & Fraud
No commissions will be paid on:
- Refunded purchases
- Cancelled orders
- Fraudulent transactions
- Self-referrals unless explicitly approved
If commissions were previously paid on such transactions, the Company may deduct them from future payouts.
7. Compliance with Cannabis Laws
Affiliates acknowledge that cannabis advertising is heavily regulated.
Affiliates must comply with:
- Local cannabis advertising laws
- Age-restriction requirements
- Platform-specific cannabis promotion policies
- Social media advertising restrictions
The Company is not liable for violations committed by affiliates.
8. Intellectual Property
Affiliates may use approved logos, banners, and promotional materials supplied by the Company solely for Program participation.
Affiliates may not:
- Modify Company branding without permission
- Register domains or social accounts similar to the Company
- Claim ownership of Company intellectual property
All rights remain the property of the Company.
9. Termination
Either party may terminate participation at any time.
The Company may immediately terminate an affiliate for:
- Violating this Agreement
- Illegal or unethical conduct
- Fraudulent marketing practices
- Regulatory violations
Upon termination:
- Affiliate links may be disabled immediately
- Unpaid commissions associated with violations may be forfeited
10. Limitation of Liability
The Company shall not be liable for:
- Indirect or consequential damages
- Loss of profits or revenue
- Tracking interruptions or technical failures
Participation in the Program is at the Affiliate’s own risk.
11. Indemnification
Affiliates agree to indemnify and hold harmless the Company from any claims, damages, penalties, or legal actions arising from:
- Affiliate marketing activities
- Violations of advertising laws
- Misrepresentation of products or services
12. Confidentiality
Affiliates shall not disclose confidential business information, including:
- Commission structures
- Marketing strategies
- Customer information
- Internal business operations
13. Modification of Terms
The Company may update these Terms at any time. Continued participation after updates constitutes acceptance of the revised Agreement.
14. Governing Law
This Agreement shall be governed by the laws of the United States of America.
Any disputes shall be resolved in the courts located within that jurisdiction.
